The $25,000 Pattern Day Trader Rule Is Gone: FINRA’s Intraday Margin Rollout

Last updated: 16 October 2026 Is the $25,000 pattern-day-trader rule really gone, and when does it stop applying at your broker? This page sets out the dates from FINRA’s own notices and the SEC’s approval order, what the new intraday margin standards change, and how interest in the old rule moved.

Key findings · FINRA intraday margin rollout

The $25,000 pattern-day-trader minimum is gone from FINRA’s rulebook. FINRA’s new intraday margin standards replaced the day-trading margin rules “in their entirety”, including the four-day-trade count used to flag “pattern day traders” and the $25,000 minimum equity, effective 4 June 2026 (Regulatory Notice 26-10).

Your broker may not have switched yet. Firms that need more time can phase the change in over 18 months, until 20 October 2027, so some brokers can keep applying the old rules until then.

Margin still applies, just measured differently. Brokers now track an “intraday margin deficit” each day. A deficit must be covered as promptly as possible, and a customer who makes a practice of not covering one within five business days faces a 90-day restriction.

Interest jumped when it was approved. Views of Wikipedia’s “Pattern day trader” article went from 1,148 in March 2026 to 2,636 in April and 3,263 in June, the month the change took effect, then fell to 818 in August.

The table summarises Regulatory Notice 26-10 and the rule text in its Attachment A. Brokers can set stricter “house” requirements than FINRA’s minimums, so check your own broker’s margin agreement.

Why it matters for prop firm traders

The $25,000 rule was one reason small US accounts turned to futures or to prop firm evaluations, since it never applied to futures accounts, which fall under the CFTC and NFA rather than FINRA’s securities margin rule. With the rule gone, a US trader with less than $25,000 can day trade stocks in a margin account without the four-trade limit, once their broker has made the switch. Margin requirements, broker house rules and the risk of losses all still apply. We aren’t predicting how this will affect demand for prop firms; the timeline and the search-interest data below are the facts we can check.

Who weighed in

The SEC’s comment file for SR-FINRA-2025-017 includes letters from Charles Schwab, Cboe Global Markets, Lightspeed Financial Services and the Security Traders Association, alongside many individual traders, and a FINRA response dated 18 March 2026. The newest letter listed on 16 October 2026 is dated 11 August 2026.

Caveats

This page is general information, not legal or financial advice. Brokers may keep stricter house rules, and those still in the phase-in period may apply the old rules until 20 October 2027.

The change covers FINRA member brokers’ securities margin accounts. It doesn’t change futures margin, cash-account settlement rules, or any prop firm’s own rules.

Wikipedia views are a rough signal of interest, not a count of traders.

Common questions

Is the pattern day trader rule gone?

Yes, at the FINRA level. FINRA's intraday margin standards replaced the day-trading margin rules, including the pattern-day-trader designation and the $25,000 minimum, effective 4 June 2026. Brokers may phase the change in until 20 October 2027.

When will my broker drop the $25,000 minimum?

Each broker chooses within the phase-in window, which ends on 20 October 2027. Some may also keep stricter house requirements. Ask your broker or check its margin disclosures.

What replaced the PDT rule?

Intraday margin standards in FINRA Rule 4210(d)(2). Brokers calculate an intraday margin deficit for each margin account on days with margin-reducing trades, and the customer must cover it as promptly as possible.

Did the PDT rule apply to futures or prop firm accounts?

No. It was a FINRA rule for securities margin accounts at broker-dealers. Futures accounts are regulated by the CFTC and NFA, and prop firm evaluations follow each firm's own rules.
