Last updated: 15 October 2026 (crypto filing status and comment count; other rows as of 11 October 2026) Which CFTC proposals are open for public comment right now, and which just closed? We pulled every CFTC document in the Federal Register since 1 January 2025 from the Federal Register API, kept the proposed rules, final rules and comment-seeking notices, and added each comment deadline, comment-period length and status as of 11 October 2026.
24 CFTC proposed rules and requests for comment in the Federal Register since 1 January 2025. 20 came in 2026. The count comes from the Federal Register API and covers CFTC documents of type “Proposed Rule” only; final rules and other notices are in the CSV.
As of 15 October 2026, 2 are open for comment. Request for Comment on the Listing of Compute Derivatives Contracts (closes 20 Oct 2026); Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets (closes 14 Dec 2026 at 11:59 PM ET). The crypto filing, 2026-20888, is an advance notice of proposed rulemaking (ANPRM), an early step before any proposed rule text. The typical comment window is 32 days. Across the 21 proposals that list a deadline, comment periods ran from 10 to 62 days (median 32). 3 proposals list no comment deadline in the API.
Swaps, event contracts and margin dominate the topic list. By our keyword tags, swaps lead with 8 of the 24 proposals, then prediction markets / event contracts (4) and margin (2); 24/7 trading and crypto assets have 2 and 1. Tags are keyword matches on each title and abstract, not CFTC categories.

The CSV also has the 26 final rules and 3 comment-seeking notices in the same period (privacy-system and Commitments of Traders notices). We left out 76 routine Paperwork Reduction Act “Agency Information Collection” notices, which also carry comment deadlines but are not rulemakings.
Why a prop trader might care
Most CFTC rulemaking is about exchanges, clearing houses and swap dealers, not about funded-account firms. The rules that touch retail futures and forex customers are the ones on margin, 24/7 futures trading, event contracts, crypto-asset markets and the registration of commodity pool operators and trading advisors. We tag them, we do not rank them, and nothing here says any proposal applies to a particular firm. Our legal explainer covers what US federal law does and doesn’t say about prop firms.
SEC proposals and deadlines
The SEC runs its own comment periods, and some proposals are joint with the CFTC. Comments on the SEC’s Regulation Crypto Assets (Federal Register 2026-17183) close on 20 October 2026, and 10 SEC proposals were open on 17 October 2026. All 25 SEC proposed-rule documents of 2026 are on our SEC proposed rules and comment deadlines tracker.

Method
Query: Federal Register API, agency slug commodity-futures-trading-commission, publication date on or after 2025-01-01, all pages (138 documents). We keep type Proposed Rule and Rule, plus Notices that list a comment deadline and are not Paperwork Reduction Act collection notices.
Status is computed from the comment deadline the API gives (comments_close_on) against 11 October 2026. A proposal published after that date is shown as scheduled. Comment-period days = deadline minus publication date. Topic tags are our keyword matches (prediction market or event contract, crypto, 24/7, margin, swaps, CPO/CTA, Form PF and a few others) applied to the title first and the abstract second.
Caveats
Deadlines can be extended or reopened by a later notice, and the API reflects only what the Federal Register has published. Check the notice itself before relying on a date. Some CFTC actions never go through the Federal Register, so this is not the CFTC’s complete agenda.
A proposal being open for comment is not a prediction that it will become a rule. Tags are not legal advice and do not mean a rule applies to any prop firm. Document 2026-20888 was published in the Federal Register on 13 October 2026 (91 FR 64811) as an advance notice of proposed rulemaking. Regulations.gov gives the deadline as 15 December 2026, 04:59 UTC, which is 14 December 2026 at 11:59 PM ET. Comment counts change daily; check the docket for the current number.
