What the public filings say the cases are about

Where a complaint is publicly available, this is what it says, as allegations only. The 6 Oct 2026 Western District of Texas case, Apex Trader Funding, Inc. v. Riot: the docket lists a complaint, a summons request and an issued summons, but no nature of suit or claims, and the complaint is not in the free RECAP archive, so we do not describe it. The 2 Apr 2026 Southern District of California case against Apex is captioned a class action complaint and jury demand; its single count cites 47 U.S.C. § 227(c) and 47 C.F.R. § 64.1200(c)(1), the federal telemarketing rules. The 9 Apr 2026 Middle District of Florida case against Topstep entities was filed without a lawyer; its complaint says it gives rise to claims for operation of an unregistered commodity pool, fraud and manipulation under the Commodity Exchange Act, breach of contract, fraudulent inducement, violation of the Florida Deceptive and Unfair Trade Practices Act, conversion, unjust enrichment, breach of fiduciary duty and unconscionability. For the 30 Apr 2026 Middle District of Florida case against Apex, the complaint is not in the free archive, so the claims are unknown to us. None of these allegations has been decided.

How to read this

  • A filed complaint is an allegation. None of the open cases has a finding on the merits. The Delaware ruling denied a motion at the pleading stage and is not a finding of breach.
  • “Open” means there is no termination date on the docket in CourtListener.
  • RECAP is incomplete. It covers federal dockets that someone has accessed, and few state courts. A missing case is not evidence that no case exists.
  • Other firms. Name searches for the other eight firms returned only unrelated cases, which we excluded. The My Forex Funds enforcement case is covered separately on our legal page.
